This is an English courtesy translation. The binding text is the Italian version, which prevails in case of discrepancy.

      By accessing or using the VIBEST application you fully accept these Terms of Service. If you do not accept the Terms, you may not use the platform.
    

1. Acceptance of the terms

By accessing or using the VIBEST application ("the Platform"), the user fully accepts these Terms of Service ("Terms") and the Privacy Policy. Continued use of the service after updates to the Terms constitutes acceptance of the changes.

2. Description of the service

VIBEST is an Italian social platform that allows makers, freelancers and users to:

Create a professional profile and publish Vibe Posts (photos, videos, audio).
Publish Day Vibes: story-style content visible to everyone for 24 hours.
Create and join Team Vibes: group collaborations with a feedback and medal system.
Use 1-to-1 private chat, Team Vibe group chat and the chats attached to listings (text, voice, photos, videos).
Tag other users in posts and comments through @mentions.
See other users' online/offline presence.
Receive push notifications for listings published by nearby users in the same professional category.
Publish and reply to listings (seeking/offering collaboration or work).
Sell and buy items through the built-in marketplace (Shop).
Receive profile verification levels (Bronze, Silver, Gold, Purple) with a visual aura and greater visibility in feeds.

VIBEST reserves the right to change, suspend or discontinue any feature at any time, with or without notice.

3. Access requirements and account management

To use VIBEST you must:

Be at least 18 years old. Minors may be present only through a profile managed by a parent or legal guardian, in the categories expressly allowed (e.g. "Football Prospect", "Sports Prospect").
Provide accurate and truthful information at registration (verified through email OTP).
Keep your login credentials confidential and not share them with third parties.
Be responsible for all activity carried out from your account.

Registration is personal and non-transferable. Creating multiple or fake accounts is prohibited. The username is saved in the format chosen (case-sensitive).

You can change email and password from the Settings section after entering your current password for identity verification. Changing the email requires confirmation through a link sent to the new address.

4. Content upload formats

VIBEST supports the following upload formats:

Photos: JPG, PNG (automatically compressed to optimise performance).
Videos: MP4, MOV (automatically compressed; recommended maximum length 3 minutes).
Audio (Vibe Posts only): MP3, M4A, AAC.

Uncompressed formats (WAV, FLAC, AIFF) are not accepted for audio uploads. An audio file excludes attaching photos or videos in the same Vibe Post at the same time, and vice versa. By uploading content, you accept that it may be resized or compressed to optimise distribution.

Audio and video content published in Vibe Posts is subject to the same rules on prohibited content that apply to all other content on the platform. In particular, it is prohibited to publish tracks or audio/video recordings for which you do not hold the rights, pornographic or violent material, or material that violates the privacy or image of third parties.

5. User content and licence

You are solely responsible for the content you publish on VIBEST (including posts, images, videos, audio, texts, comments, listings, shop items and messages). By publishing content, you represent and warrant that:

You own the rights or have the necessary permissions to publish it.
The content does not violate applicable laws, third-party rights or these Terms.
The content was not obtained from other platforms without permission (unauthorised downloads, reposts of other people's content, rips from third-party social networks).

You grant VIBEST a non-exclusive, royalty-free, worldwide licence, revocable by deleting the content itself, to:

Host, store, reproduce and distribute the content through the technical infrastructure of the service.
Technically adapt the content (compression, format conversion, resizing, generation of previews and thumbnails) to allow its publication and use on different networks and devices.
Display the content to other users within the service.
Use the content to promote the Platform (e.g. previews, featured content, app store materials, VIBEST's official social channels), always with visible attribution to the author.

By publishing public content, you accept that other users may share it outside the Platform too through the app's sharing functions, always with attribution and a link to the original content.

Ownership rights remain entirely with the user: VIBEST claims no rights over your creative content beyond what is strictly necessary for the service to work.

6. Prohibited content

It is strictly prohibited to publish, share or transmit content that:

Is illegal, obscene, pornographic, violent, or promotes unlawful activities.
Constitutes harassment, discrimination, or incitement to hatred based on race, religion, gender, sexual orientation, nationality or disability.
Violates third-party rights (copyright, trademarks, privacy, image).
Contains viruses, malware or harmful code.
Is spam, unauthorised advertising or misleading communication.
Spreads false or misleading information (fake news, impersonation of real people).

VIBEST reserves the right to remove any infringing content and to suspend or terminate the account of the responsible user without notice.

7. Day Vibe

Day Vibes are story-format content visible to all users of the platform for 24 hours from publication. When they expire, the Day Vibe is automatically removed from the public feed, but may remain in technical backups for up to 90 days. The user is responsible for content published as a Day Vibe as for any other type of post.

8. Team Vibe and medals

Team Vibes are group collaborations created within the Platform.

At the end of a Team Vibe, participants can give feedback (by mutual agreement / no reason given), visible on the public profile of everyone involved.
Medals are virtual recognitions given between collaborators: they have no monetary value, are not transferable outside the platform and cannot be purchased.

VIBEST reserves the right to cancel or remove medals or feedback in case of abuse of the system.

9. Parent-managed profiles

Some categories (e.g. "Football Prospect", "Sports Prospect") allow profiles for minors managed by a parent or legal guardian. The parent/guardian who registers or manages a profile for a minor:

Fully accepts these Terms on behalf of the minor.
Is responsible for all content published, interactions and transactions of the profile.
Guarantees that the information provided is accurate.
Can request account deletion following the procedure on the Delete account page.

VIBEST does not verify the identity of the parent/guardian. Responsibility lies entirely with the adult managing the profile.

10. Chat and communications

VIBEST offers three types of chat:

1-to-1 private chat: between any two users.
Team Vibe group chat: accessible to the participants of the Team Vibe.
Listing chat: attached to a specific listing.

In all chat types you can send text messages, voice messages (audio), photos and videos. The same format limits and the same rules on prohibited content also apply to media sent in chat.

Messages are not publicly accessible. In case of serious reports (safety, crimes), VIBEST may access the relevant messages to comply with legal obligations. The user is responsible for the content of their own messages.

11. Marketplace, Shop and Listings

VIBEST provides marketplace (Shop) and listing (Seeking/Offering) features to allow users to publish items for sale or collaboration requests. In this context:

VIBEST acts exclusively as a technical intermediary: it is not a party to transactions between users, does not handle payments, holds no stock and does not verify the identity of counterparties.
VIBEST does not guarantee the quality, authenticity, safety, availability, legality or truthfulness of items, listings or services published by users.
All transactions, payments and deliveries take place outside the Platform, directly between the parties involved.
VIBEST is not responsible for any disputes, non-performance, fraud, scams or damages arising from transactions between users.
Users are responsible for complying with applicable tax rules (e.g. declaring income from sales, VAT where due).

If a listing looks suspicious, report it immediately through the "Report" function. VIBEST reserves the right to remove non-compliant listings without notice.

11b. Indemnity

The user undertakes to indemnify and hold harmless Daniele Bonalberti and VIBEST (including collaborators, technical processors and successors) from any claim, demand for compensation, loss, damage, cost or expense (including reasonable legal fees) arising from or in any way connected to:

Content published, transmitted or shared by the user through the Platform.
Violation of third-party rights (copyright, trademarks, image rights, privacy, defamation).
Violation of these Terms or of any applicable law or regulation.
Improper, fraudulent or unlawful use of the Platform (including use of bots, scraping, exploiting bugs or vulnerabilities).
Transactions, disputes or business dealings entered into with other users through the marketplace or listing features.

12. Profile verification and badges

VIBEST assigns verification levels (Bronze, Silver, Gold, Purple) based on internal criteria.

Each level corresponds to a visual aura on the profile, proportional to the degree of verification.
Content from verified users receives greater visibility in feeds (home, listings, shop) proportional to the level.
The assignment criteria are not publicly disclosed, to prevent behaviour aimed at gaming them.
VIBEST reserves the right to assign, revoke or change levels at any time and without needing to give reasons.
Badges have no commercial or contractual value.

13. Intellectual property

The VIBEST name, logo, design, source code and all content created by the Platform are the exclusive property of Daniele Bonalberti and are protected by copyright and trademark laws. Reproduction, copying, modification, distribution or commercial use of these elements without the owner's written permission is prohibited.

14. Copyright reports and DMCA

If you believe that content on VIBEST infringes your copyright, you can:

Use the "Report" function directly on the content in the app.
Send a formal notice to support@vibestapp.com with the subject "Copyright Infringement", including: a description of the infringed original work, the identifier of the content on VIBEST, and a statement of your ownership or authorisation to act.

VIBEST undertakes to remove content that infringes established copyright within 72 working hours of receiving a valid notice. False or abusive notices may lead to the suspension of the reporting account.

Repeated infringements: users who, following valid notices, are found to have repeatedly published copyright-infringing content are suspended and, in case of a further infringement, their account is permanently closed.

Covers and third-party tracks: to publish covers of third-party tracks you are responsible for having obtained the necessary licences (SIAE, SCF, etc.). VIBEST does not provide music licences.

15. Content moderation

VIBEST uses automated moderation tools (including image analysis systems) and human review to identify and remove non-compliant content.

Users can report content or profiles through the "Report" function available in the app.
Moderation decisions are final. You can appeal by writing to support@vibestapp.com within 14 days.
Repeated and confirmed violations may lead to permanent suspension of the account.

16. Limitation of liability

To the fullest extent permitted by Italian law:

VIBEST is provided "as is", without warranties of any kind, express or implied.
VIBEST does not guarantee continuous and uninterrupted availability of the service.
VIBEST is not liable for direct, indirect, incidental or consequential damages arising from the use or inability to use the service.
VIBEST is not responsible for users' behaviour or for the content they publish.

Nothing in these Terms excludes or limits VIBEST's liability for wilful misconduct or gross negligence, nor consumer rights provided by Italian law (Legislative Decree 206/2005 — Consumer Code).

17. Account suspension and deletion

VIBEST may suspend or delete your account in case of:

Violation of these Terms.
Harmful behaviour towards other users or towards the Platform.
Prolonged inactivity (over 24 months).

You can delete your account at any time from the app's Settings section. Deletion entails the permanent loss of all data, content, medals and verification levels linked to the account, under the terms described in the Privacy Policy.

18. Regulated professions and declaration of qualification

VIBEST allows profiles in professional categories regulated by Italian law, including — by way of example and not exhaustively — the macro-categories Health & Medicine (doctors, dentists, psychologists, nurses, pharmacists, veterinarians, physiotherapists, nutritionist biologists, dietitians and similar) and Legal & Consulting (lawyers, notaries, accountants, labour consultants, experts and similar).

By selecting a regulated profession, the user expressly declares, under their own responsibility, that they:

hold the qualifications required by Italian law to practise that profession;
are duly registered with the relevant professional register or order, where required;
are aware that a false declaration is a criminal offence under art. 76 of Presidential Decree 445/2000 and that the unauthorised practice of regulated professions (health, legal and similar) is punished under art. 348 of the Italian Criminal Code with imprisonment and a fine.

VIBEST does not verify the professional qualifications declared by users and is in no way liable for false declarations, unauthorised practice of a profession, wrong advice or damages — direct or indirect — arising from interactions between users based on such declarations. Every user is invited to independently verify the qualifications of anyone giving health, legal or financial advice through the public registers of the Italian professional orders.

VIBEST reserves the right to suspend or remove profiles whose declaration of qualification is manifestly false or the subject of a qualified report.

19. Network marketing, pyramid schemes and affiliate schemes

VIBEST is dedicated to showcasing genuine professional, craft, creative, sports and volunteering skills. The platform is not intended for recruitment into network marketing (MLM) schemes, pyramid selling or the promotion of earning opportunities structured on affiliation levels.

Profiles and content mainly dedicated to recruiting new affiliates or promoting earning opportunities through commercial networks may be suspended or removed at the discretion of moderation, without prejudice to users' ability to promote their own products or services in the Shop section in compliance with the community Guidelines.

20. Changes to the terms

VIBEST reserves the right to change these Terms at any time. Substantial changes will be communicated with at least 15 days' notice through an in-app notification or email. By continuing to use VIBEST after the effective date of the changes, you accept the new Terms.

21. Governing law and jurisdiction

These Terms are governed by Italian law. For disputes with consumers, the court of the user's place of residence has jurisdiction. For professional users, the court of Milan has exclusive jurisdiction.

22. Web tools and purchase of creations

At vibestapp.com/strumenti VIBEST provides writing tools (for example for the bio and for captions) usable from the browser without an account. This section applies to anyone who uses them, even without being signed up to the app.

22.1 How they work

The tools use an artificial intelligence service to reorder and correct the text you write. The result is a proposal: it may contain errors or inaccuracies, it must be re-read before use, and you remain solely responsible for what you publish. Do not enter other people's personal data or confidential information in the tools.

22.2 Free creations

Each person has a limited number of free creations per day, shown on the tool page. VIBEST may change this number, suspend or close the tools at any time. Automated use or use aimed at circumventing the limits is prohibited.

22.3 Paid packs of creations

Those who want to continue beyond the free creations can buy a pack: 3 creations for €1, 10 creations for €3, 25 creations for €6. The price is the one shown on the page at the time of purchase and is the total amount you pay. Payment is made through PayPal (with a PayPal account or a card): VIBEST does not receive or store your card data. The receipt is sent to you by PayPal.

22.4 The code

Once payment is confirmed you receive a code containing the purchased creations. The code works for all tools, on any device, and does not expire as long as the service is active. It is a bearer code: anyone who knows it can use its creations, so keep it safe and do not publish it. A creation is deducted only when the tool delivers a result: if generation fails because of an error on our side, it is not deducted.

22.5 Right of withdrawal

Creations are digital content supplied immediately after payment. By pressing the purchase button you expressly request that supply begins immediately and accept that, for this reason, you lose the 14-day right of withdrawal (art. 59, para. 1, letter o, Italian Consumer Code). Your rights remain intact if the service is not supplied: if you paid and did not receive the code, or the code does not work for a cause attributable to us, write to support@vibestapp.com with the PayPal order number and we will deliver the code or refund you.

22.6 Closure of the service

If VIBEST decides to close the tools, it will announce it on the tool pages with at least 30 days' notice. Those who still have purchased, unused creations during that period can request a proportional refund by writing to support@vibestapp.com.
